This Related Service Data Notice (“Notice”) is issued by EZVIZ, as the provider of Related Service with the Connected Product, in order to provide users of Related Service (“you”) with the legally required information about the Product Data to be obtained and the Related Service Data to be generated (together the “Data”).

For purposes of this Notice, the Connected Product refers to those products you connect to your EZVIZ APP account, and the Related Service refers to the EZVIZ APP services that you utilize to manage and use your Connected Products.

The data holder, which is the relevant EZVIZ entity providing the Related Service to you through EZVIZ APP, may vary depending on your region. For details, please refer to the Regions regarding EZVIZ Services Notice.

 

Terms of Software License and Service for EZVIZ APP is the contract between you and EZVIZ that governs the provision of the Related Services. Please refer to it for the duration and termination of the contract.

The Notice may be modified from time to time, and any updated versions will be posted on this webpage. The Notice covers the following:

1.         Definitions;

2.         Product Data nature, estimated volume, and collection frequency;

3.         Related Service Data nature and estimated volume;

4.         Your Rights and Retention of the Data;

5.         Whether and Why EZVIZ expects to use the Data;

1.      Definitions

Connected Product means an item that obtains, generates or collects data concerning its use or environment and that is able to communicate Product Data via an electronic communications service, physical connection or on-device access, and whose primary function is not the storing, processing or transmission of data on behalf of any party other than the user.

Product Data means data generated by the use of a Connected Product that the manufacturer designed to be retrievable, via an electronic communications service, physical connection or on-device access, by a user, data holder or a third party, including, where relevant, the manufacturer.

Related Service means a digital service, other than an electronic communications service, including software, which is connected with the product at the time of the purchase, rent or lease in such a way that its absence would prevent the Connected Product from performing one or more of its functions, or which is subsequently connected to the product by the manufacturer or a third party to add to, update or adapt the functions of the Connected Product.

Related Service Data means data representing the digitization of user actions or of events related to the Connected Product, recorded intentionally by the user or generated as a by-product of the user’s action during the provision of a Related Service by the provider.

3.      Related Service Data nature and estimated volume

The Related Service connected with the Connected Products will generate the Related Service Data as specified below:

4.      Your Rights and Retention of the Data

Under the Data Act, you have the right to access your data within specified limits. To exercise this right, please refer to the EZVIZ APP Privacy Policy or contact EZVIZ using the details provided in this Notice. You may also reach out to request or terminate data sharing. Upon receipt of your request, we will respond in accordance with legal requirements.

The Data will be stored in the data centers of Related Service, and retained in accordance with EZVIZ APP Privacy Policy.

5.      Whether and Why EZVIZ expects to use the Data

EZVIZ use the Data only for the purpose listed in EZVIZ APP Privacy Policy.

6.      Identity of the trade secret holder

Your use of EZVIZ APP is subject to the Terms of Software License and Service for EZVIZ APP. EZVIZ retains the ownership of any trade secrets contained if any in the data accessible from Connected Products or generated through the provision of the Related Services. You are solely responsible for managing any trade secrets within your own data.

7.      How to contact us and lodge a complaint

If you have questions about the Notice, you can contact EZVIZ at privacy@ezviz.com. We will respond to your inquiry as soon as reasonably possible. Please provide: (i) your name (or nickname), your country/region of residence and your preferred method of communication; and (ii) the details of your request or comment.

You also have the right to lodge a complaint with the competent authority that is responsible for the application and enforcement of the Data Act in your country/region.
