THIS DOCUMENT CONTAINS VERY IMPORTANT INFORMATION REGARDING YOUR RIGHTS AND OBLIGATIONS, AS WELL AS CONDITIONS, LIMITATIONS AND EXCLUSIONS THAT MIGHT APPLY TO YOU. PLEASE READ IT CAREFULLY.
A fee-based new feature for monitoring and alerting the suspected abnormal status of Products networking, namely EZVIZ Products Cloud Inspection Service (the “Device Inspection Service” or “Service”), is available now in EZVIZ apps. You may choose to subscribe this Service to proactively monitor the status or conditions for the Products you connected to the EZVIZ Apps, via the alerts as your setting, which is a kind of the system message in you EZVIZ Apps, for the suspected abnormal networking status, such as offline, network fluctuating, failure of your local memory card or EZVIZ CloudPlay Service (if applicable).
These Terms and Conditions (“Terms”) shall govern your use of EZVIZ Products Cloud Inspection Service.
PLEASE READ THESE TERMS CAREFULLY. If you do not agree with these Terms, please do not use this Services.
If you reside outside of these regions (the link: https://www.ezviz.com/page/Regions-regarding-EZVIZ-Services-Notice), your agreement is with EZVIZ Inc., and if you reside in these regions (the link: https://www.ezviz.com/page/Regions-regarding-EZVIZ-Services-Notice), your agreement is with EZVIZ International Limited (hereafter referred be “we” or “us”).
YOU MAY NOTORDER OR USE THE SERVICE IF YOU (A) DO NOT AGREE TO THESE TERMS, (B) ARE NOT THE OLDER OF (i) AT LEAST 18 YEARS OF OR (ii) LEGAL TO FORM A BINDING CONTRACT WITH US, OR (C) ARE PROHIBITED FROM ACCESSING OR USING OR EZVIZ APPS BY APPLICABLE LAW.
These Terms are incorporated into the Terms of Software License and Service for EZVIZ App (the link: https://www.ezviz.com/legal/terms-of-service-app), which also apply when you use EZVIZ Products Cloud Inspection Service.All matters not covered herein shall be subject to the Terms of EZVIZ App.
1. Notes
Necessary Conditions. To use Device Inspection Service, you need compatible hardware (such as your Products), software (latest version recommended and sometimes required) and Internet access (at your own expense, if any).Our Services’ performance may be affected by these factors. Furthermore, please noted that it is necessary for EZVIZ access to your Products and/or the network you use.
Only for networked devices. This Device Inspection Service is implemented through remote monitoring software technology on the EZVIZ Cloud Platform. Therefore, if your Products have never been connected to the EZVIZ Apps, this Service cannot be enabled.
Available separately for each Product. A Device Inspection Service package shall only be available for one Product. You should subscribe the Service separately for per Products when needed.
2. Access to Device Inspection Service
Free Trials. In some preset situations, you may access to the Device Inspection Service for free at a trial period of seven (7) days (“Free Trials”). The Free Trials may be terminated at: (a) seven says expire. You will be notified when the Free Trials go to expire. If you do not plan to subscribe the Service for a fee, please cancel it at least 24 hours before it ends; (b) disabled or cancelled by you; or (c) crowded out by a Paid Subscription. Please note that you cannot reactivate the Free Trials once terminated, and no extra remedy will be offered.
Paid Subscription. Various fee-based subscription packages for the Device Inspection Service (“Paid Subscription”) may be offered in the EZIVZ Apps. If you choose to purchase a Paid Subscription, you agree to pay the applicable charge associated with that Subscription, and you’re responsible for all applicable taxes. We may suspend or cancel the Paid Subscription if we do not receive a timely and complete payment from you.
You will be asked to provide a payment method when you register for the Paid Subscription. You can access your billing information and payment method by signing into your account on EZVIZ apps, where applicable. You agree that we may use any updated account information regarding your selected payment method provided by your issuing bank or applicable payment network. You agree to keep your billing account and contact information current at all times. Changes made to your billing account will not affect charges we submit to your billing account before we could reasonably act on your changes to your billing account.
By providing payment method, you:
Represent that you are authorized to use the payment method that you provided and that any payment information you provide is true and accurate;
Authorize us to charge you for the Service using your payment method.
3. Automatic Renewal based on Paid Subscription
When you enroll in a Paid Subscription for automatic renewal of the Device Inspection Service, we will automatically renew your subscription at the end of the applicable period. In other words, we will automatically bill you from the date you subscribed to the Service, and on each periodic renewal until cancellation.
When you sign up for a Paid Subscription, you acknowledge and agree that you are authorizing recurring payment on (a) monthly or (b) annually basis, and payments will be made to us by the method and at the recurring intervals chosen by you, until the Paid Subscription is terminated by you or by us. By authorizing recurring payments, you are authorizing us to process such payments.
Please note that your Paid Subscription will remain in effect until it’s cancelled or terminated. If you remove a registered payment card or a renewal charge is rejected by your financial institution, your Paid Subscription will be terminated at the end of your subscription period.
You may cancel your Paid Subscription at any time, with or without cause, by logging in your account via EZVIZ apps and following the cancellation instruction.
PLEASE PAY CAREFUL ATTENTIONTO THE EFFECTIVE PERIOD OF YOUR CURRENT SUBSCRIPTION. YOU MUST CANCEL THE PAID SUBSCRIPTION BEFORE THE RENEWAL DATE TO AVOID BEING AUTOMATICALLY BILLED IF YOU DO NOT NEED TO RENEW.
4. Changes.
Price Changes. We will provide notice of price and fee changes by sending a message to the email address associated with your account. Price changes will take effect at the beginning of the next payment interval. If you do not agree to the price or fee change, you must cancel the paid subscription (if applicable) and stop using the Service before the change takes effect.
Inspection Items Changes. We reserve the right to change the Inspection Items associated with Device Inspection Services. These changes usually refer to the addition of inspection items, which is kinds of improvement in the Service performance. We will notify you in advance of the Inspection Items Changes if necessary.
5. No Refunds
If technical problems prevent or unreasonably delay delivery of the Device Inspection Services, your exclusive and sole remedy is the replacement of the Service, unless the refunds are required by law. For example, users living in the European Union have the right to cancel their Paid Subscription within 14 days of enrolling in, or renewing a Paid Subscription.
From time to time, EZVIZ may refuse a refund request if we find evidence of fraud, refund abuse, or other manipulative behavior that entitles EZVIZ to a corresponding counterclaim.
6. Privacy
We will collect, use or store some of your Personal information, including the serial number, type of network or your account information, the scope of Services you ordered, the Device and mobile equipment you used, etc., which are all necessary information for providing you with the Service you ordered.
We respect your privacy and are committed to protecting it. Our Privacy Policy (the link: https://www.ezviz.com/legal/privacy-policy-app) governs the processing of all personal data collected from you in connection with your order and/or use of our Device Inspection Service.
7. Miscellaneous
Severability. If any provision of these terms is invalid, illegal, void or unenforceable, then that provision will be deemed severed from these terms and will not affect the validity or enforceability of the remaining provisions of these Terms.
No Waivers. The failure by us to enforce any right or provision of these Terms will not constitute a waiver of future enforcement of that right or provision. The waiver of any right or provision will be effective only if in writing and signed by a duly authorized representative of EZVIZ.
No Third Party Beneficiaries. These Terms do not and are not intended to confer any rights or remedies upon any person other than you.
